I. WEBSITE TERMS AND CONDITIONS
The Stand Up To Cancer campaign in the United Kingdom is run by Cancer Research UK (“CRUK”, “us” or “We”). Donations in support of the Stand Up To Cancer campaign in the United Kingdom go to CRUK.
CRUK is a registered charity with charity numbers 1089464 (England & Wales) and SC041666 (Scotland) and 247 (Jersey). Registered as a company limited by guarantee in England & Wales No. 4325234. Registered address: Cancer Research UK, 2 Redman Place, London, E20 1JQ.
"Stand Up To Cancer and Stand Up To Cancer Brand Marks" are registered trademarks or trademarks of the Entertainment Industry Foundation and used under licence by CRUK.
We reserve the right to change these terms and conditions at any time. You should therefore check the terms and conditions regularly.
II. WEBSITE SALE TERMS
These terms set out at https://shop.cancerresearchuk.org/content/terms-and-conditions and the additional terms below govern the basis on which we will supply items from our shop to you, so please read them carefully. We may amend these from time to time, and the changes will take effect from the time we publish the revised terms. However, the amended terms will not apply to any orders that we have already accepted before this date.
Net profits from the sale of items in our Stand Up To Cancer UK shop will be administered by Cancer Research UK in support of the UK Stand Up To Cancer campaign and awarded as grants to fund collaborative cancer research that will benefit patients in the UK.
These terms set out the basis on which we will supply items from our shop to you, so please read them carefully. We may amend these from time to time, and the changes will take effect from the time we publish the revised terms. However, the amended terms will not apply to any orders that we have already accepted before this date.

If we are unable to deliver any item to you within 30 days of accepting your order, you may cancel your order if:
A) we have refused to deliver your item(s); or
B) it was essential that delivery took place within this time (taking into account all the relevant circumstances), or you told us before we accepted your order that delivery within this time was essential.
If you don’t want, or aren’t entitled, to cancel your order due to late delivery, you can give us a new deadline for delivery, which must be reasonable. You can cancel your order if we then fail to deliver your item before this new deadline.
If you want to cancel your order as a result of late delivery as set out above and you have ordered more than one item, you can cancel the entire order or just part of it (and we will deliver the rest), unless splitting up your order would significantly reduce the value of the items.
If you choose to cancel due to late delivery, we will refund all sums you have paid to us for that order (including delivery charges). If your order has already been delivered, you will need to return the unwanted items to us or allow us to collect them, but we will also pay the costs of this. We reserve the right to charge for any damage caused to the item while in your possession.
We shall not be responsible to you for any delays in the delivery of items that are caused by events outside of our control. However, we will contact you as soon as possible to notify you of any such events, and we will try to minimise the effects of any delay.

Please note that in all cases of reimbursement, we will do this in the same way that you paid for your order, unless we both agree otherwise. You will not incur any fees when getting your money back.
You have a legal right to return any item that does not match the description on our website, is not fit for its intended purpose or is not of satisfactory quality. You are entitled to a refund if you tell us this within 30 days of receipt of the item, or you may request a replacement item instead. In either case you will need to return the item in question to us.
Please note that in the case of goods listed as donated on our website, you will only be entitled to return these where the fault is one that was not listed by us in the product description.
If you want a refund, we will refund all sums you have paid to us for that order (including delivery charges), together with your costs of returning the item to us, once we receive the relevant item back and agree there is a problem with it.
If you want a replacement (and we have one in stock), we will reimburse you with your costs of returning the item back to us once we receive the relevant item back and agree there is a problem with it.
If you tell us after 30 days of receipt that the item is faulty, you will be entitled to a refund as set out above if we can’t repair your item or offer you a replacement.
Cancelling your order
You can cancel an order by doing one of the following:
• A) submitting our cancellation form to the following address: CRUK Returns, c/o Paragon CC, Unit 5, Bessemer Park, Templeborough, Rotherham, S60 1EN, or by email to CRUKORDERS@paragon-cc.co.uk;
• B) contact us using the details at the top of these terms, providing us with details of your order in order to allow us to identify your purchase; or
• C) returning the item to us with a copy of your receipt and your customer advice note, confirming that you wish to cancel your order
If you cancel your order before we dispatch it, we will refund all sums you have paid to us for that order (including delivery charges) within 14 days of you telling us you want to cancel.
If you wish to cancel your order once you have received it, you should send the items back to us as soon as possible, and in any event not later than 14 days from the day you tell us you want to cancel your order. You will be responsible for the costs of returning the items to us.
We will then refund you the following sums:
• A) the purchase price; and
• B) our standard delivery charge (even if you ordered our next day delivery service when purchasing your item)
These will be paid within 14 days of receiving the item back from you or you providing evidence that you returned the item to us (if earlier).
Please note that we may make a deduction if the value of the item has been reduced as a result of your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the item, and later discover you have handled it in an unacceptable way, you will be required to pay us an appropriate amount.
We also offer the chance for our customers to return items and ask for a replacement, with no questions asked. This is in addition to your rights to a replacement item if the original is damaged or faulty (see “Damaged/Faulty Goods” above). Please note that we are only able to replace identical products, although requests for different sizes are acceptable. If you wish to order additional items this will be treated as a new order.
If you wish to exchange an item, please send it back to us within 14 days of receipt, in a resalable condition, together with the customer advice note. Items returned must be unopened with any seals and shrink-wrap intact (e.g., for CDs and DVDs, electronics, food).
Please note that we cannot exchange the following items:
- A) pierced earrings and pierced body jewellery
- B) gift food
- C) goods listed as donated
- D) flowers
- E) personalised goods
- F) clearance items reduced to half price or less
We are also unable to exchange the following items unless the following conditions have been met:
A) underwear/lingerie and swimwear - please ensure that such items are tried on over your own underwear, as we reserve the right to refuse an exchange where it is apparent this is not the case
B) quilts, duvets and pillows unless the original packaging remains undamaged and unopened cosmetics and toiletries and towels - we will accept returns if they are in a saleable condition with unbroken seals and packaging
C) hats and hair accessories unless unworn and the tags still in place
Special Offers and Discounts
Special Offers - from time to time, we may advertise special offers on our website. Special offer prices quoted apply only to orders completed on this website.
Free gifts - from time to time, free products may be offered with an item or order. These free gifts are included as part of your order and if any part of the order is returned for a refund, we reserve the right to deduct the value of the free gift from your refund if they are not returned too.
From time to time, we may issue voucher codes for free delivery of purchases from this website, or for discounts on orders or items. Please note the following, and contact us if you have any questions about redeeming a voucher code:
- A) you may only use one voucher code per order, and these voucher codes can only be used to purchase items from this website
- B) voucher codes expire two years from the date they are issued unless the terms of the voucher provide otherwise
- C) voucher codes for the website can only be used once
- D) the total value of the voucher code will be applied against the total order including VAT. If the item(s) purchased total less than the value of the voucher code, the remaining balance cannot be carried over or used on future purchases. If your order exceeds the amount of your voucher code, you must pay the balance
- E) some voucher codes may only be used to purchase certain item(s) from this website. Where this applies, you will be required to pay in full for any additional items you wish to purchase as part of the same order, even if the value of the promoted items you are purchasing is less than the total value of the voucher code
- F) If you have to return goods for credit originally purchased online using a voucher code, then in most instances you will receive another voucher code to use on a future purchase
Your Personal Information
We use the personal information you provide to us in order to supply the item(s) you have ordered to you and to process your payment. Your information will be accessed by Paragon Customer Communications Ltd (of Paragon Customer Communications Ltd, Park House, 16-18 Finsbury Circus, London, EC2M 7EB), our order fulfillment provider, in order to send you your order.
With your consent, we will contact you to let you know about products, offers and discounts from the CRUK Online Shop, the progress Cancer Research UK is making and to ask for financial and non- financial support.
All personal data held by us or on our behalf is held in accordance with our Privacy statement.
Our liability to you
We are responsible for any foreseeable loss or damage you suffer that is caused by our breach of these Terms or our negligence up to a maximum of the greater of: (a) £100; and (b) the cost excluding delivery of the applicable order that resulted in the loss or damage being suffered. Loss or damage is foreseeable if it is obvious it will happen, or if both parties knew it might happen at time the contract was formed.
We do not in any way seek to exclude or limit our liability to you where it would be unlawful to do so, including for:
• A) death or personal injury caused by our negligence;
• B) fraud or fraudulent misrepresentation;
• C) any breach of your statutory rights under sections 9-11, 13 and 14 of the Consumer Rights Act 2015 (i.e. items must be of satisfactory quality, fit for purpose and match any description, samples and/or model provided); or
• D) defective products under the Consumer Protection Act 1987
We only supply items for domestic and private use. You agree not to use items purchased from this website for any commercial, business or resale purposes, and therefore we shall have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
This online shop is operated by Cancer Research UK Trading Limited, a wholly-owned subsidiary company of Cancer Research UK that Gift Aids all its taxable profits to the charity. Cancer Research UK Trading Limited is a company registered in England and Wales, company number 4355631, with VAT number GB788 1386 78 and its registered office at 2 Redman Place, London, E20 1JQ.
These terms are governed by the laws of England and Wales, and the English courts shall have exclusive jurisdiction in all disputes arising out of these terms and any item(s) purchased from this website.
If a court finds any part of these terms unlawful or unenforceable for any reason, this shall not affect the rest of the terms which will remain valid and enforceable.
Even if we delay in enforcing any of these terms, we can still enforce them at a later time. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of any breach, it will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

2. 100% of your donation goes to Cancer Research UK (registered charity in England and Wales (1089464), Scotland (SC041666), Jersey (247) and the Isle of Man (1103) in support of the Stand Up To Cancer campaign. For each text message sent, you will either be charged £3, £5, £10, £20 or £30 plus your standard network message charge (based on your service provider rates) via the reply confirmation text message; the charge will show on your bill and the sender will show as a five-digit number. Please note where you have donated £20 or £30 you may receive more than one messages depending on your network operator. This is normal and a consequence of your network operator’s billing processes. This will show on your bill as either multiple charges of £10 or one charge of £20 or £30 (as applicable).
3. No VAT will be charged on your donation.

5. Please note that you can donate using this SMS service from a UK mobile only. You cannot donate using this service from a Channel Islands, Isle of Man or other non-UK mobile.

Incorrect keywords and shortcodes
9. If you enter the keyword incorrectly, your donation to the Stand Up To Cancer campaign may not be successful. In these circumstances you will receive either (a) an error message, in which case you will not make a donation, but you may still be charged your standard network message charge, or (b) a confirmation message that your donation has been successful, in which case you will be charged the relevant donation amount plus your standard network message charge as set out above.
10. If you send your text message to an incorrect shortcode, or you otherwise fail to correctly follow the instructions in these Terms and Conditions, you will not make a donation to the Stand Up To Cancer campaign but you may still be charged your standard network message charge.
11. If you are a UK taxpayer, your donation may be eligible for Gift Aid. This means we can claim an additional 25p in Gift Aid from the Government for every £1 you donate. We may contact you by text on the mobile number you used to give you the opportunity to add Gift Aid to your donation. If you are sent a link to a page where you can submit your details then, as with any mobile browsing, you may incur charges from your network provider. How monthly giving works
When you activate your monthly gift, your first donation will be taken immediately and you will also be charged a standard network message charge (based on your service provider rates); the charge will show on your bill and the sender will show as a five digit number.
Each month after your initial donation you will get a free text as a reminder, the day before your next monthly donation is due. The text will also remind you that you can choose to skip a month by replying SKIP to that text message within 24 hours. If you’re happy to give then you don’t need to do anything and you’ll be charged as usual. However, if you choose to skip a month, we won’t take the donation that month – you will just incur one standard network text message charge for sending your reply. Please note that you will receive this free monthly reminder text giving you the opportunity to skip a donation for as long as you choose to give, whether or not you have opted to receive other marketing communications from us.

III. TELEPHONE DONATION TERMS AND CONDITIONS
1. You can make a donation by phone by calling 0300 123 4444. All donations go to Cancer Research UK in support of the Stand Up To Cancer campaign. Calls to this number from the UK will cost no more than a national rate call to a 01 or 02 number and count towards any inclusive minutes in your landline or mobile call plan. Please check with your network operator for more details. This telephone donation service shall also be deemed a “Charity Donation Service” for the purposes of these terms and conditions.
You may be able to call from some countries outside the UK but we cannot guarantee this and the charges will be determined by the network operator you are calling from.
2. The lines are open 24 hours a day from 09.00 on 16 October until 23:59 on 31 March 2019. Calls will be answered by a secure automated system which will process your transaction. This automated system is being provided by GFM Holdings Limited.
3. You can donate using your debit or credit card. Please note we do not accept American Express or Diners Club cards on this number.
4. You must be 16 or over to donate.
5. There is no limit on the amount of times you can make a donation. Your donation must be in full pound denominations. There is a minimum donation of £1 and a maximum donation of £10,000 on the automated system.
6. Cancer Research UK and its subcontractors will use your personal data to administer donations made (including without limitation for the purposes of Gift Aid)
7. This service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the control of the Parties.

I. GAME ON XBOX COMPETITION
1. By participating in Game On and raising money for the Stand Up To Cancer campaign via your personal online Cancer Research UK Giving Page which is set up as part of the Game On registration process (“Giving Page”), you agree to be bound by these terms and conditions governing the award of the prize to the top fundraiser (the “Competition”). The promoter of the Competition is Cancer Research UK, 2 Redman Place, London E201JQ (the “Promoter”).
2. The Competition is open to UK residents aged 16 or over who have registered as participants for Game On at https://www.standuptocancer.org.uk/fundraise/game-on and who raise money for Stand Up To Cancer via a personal Giving Page (not via a team Giving Page), except employees of the Promoter and its subsidiary companies, together with their immediate family members and/or personal partners. For the avoidance of doubt, the Competition is not open to participants in Game On who fundraise together as a team via linked Cancer Research UK Giving Pages or to individuals or groups who fundraise solely via any third party fundraising page or platform.
3. The Promoter reserves the right to request evidence of eligibility, including the identity and age of any entrant.
4. Please email firstname.lastname@example.org by 23:59 on 30th October 2020 if you do not wish to be entered into the Competition.
5. Unless you tell us you do not want to be entered into the Competition, you will be automatically entered into it if you register for Game On between 24th August 2020 and 30th October 2020 (inclusive) and use a personal Giving Page to fundraise for Stand Up To Cancer.
6. You must ensure that all fundraising monies and donations you collect are deposited into your own Giving Page by 23.59 on 30th October 2020 (the “Closing Date”).
7. The funds deposited into your personal Giving Page by the Closing Date will make up your fundraising total (the “Fundraising Total”).
8. For the avoidance of doubt, any fundraising monies or donations deposited after the Closing Date or held in any fundraising page or platform other than your Cancer Research UK Giving Page will not be counted towards your Fundraising Total.
9. The Promoter does not accept responsibility for incorrect or incomplete personal details provided at registration and the Promoter shall also not be liable for issues of any kind which may prevent, restrict or delay the depositing of funds raised in association with Game On, including (but not limited to) technical faults such as network, computer, hardware or software failures.
10. The Promoter reserves the right to disqualify you if your conduct is contrary to the spirit or intention of Game On.
11. One Stand Up To Cancer customised Xbox Wireless Controller and one Xbox Game Pass Ultimate token valid for 6 months will be awarded to the winner (the “Prize”). Stand Up To Cancer Customised Xbox Wireless Controller (model details here), model and colour may not be exactly as shown.
12. The Promoter will provide the winner with the Xbox Game Pass Ultimate as a digital code. The Game Pass is valid for 6 months from activation and must be activated by 31-05-2021. Use of the Game Pass is subject to Xbox (Microsoft) terms of service. Xbox Game Pass renews automatically so Xbox subscription fees may apply after the initial 6 month period if you do not cancel the Game Pass before it renews, in accordance with the Xbox terms of service. 13. The winner is personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the Prize.
14. The Prize is non-transferable, non-refundable and non-negotiable. In the event of circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize for similar prizes of equal or greater value or, at its sole discretion, the cash value of the Prize.
15. By participating, entrants agree that the Prize is awarded on an “as is” basis and that the Promoter makes no representations or gives no warranties of any nature in relation to the Prize.
16. Insofar as permitted by law, the Promoter will not in any circumstances be responsible or liable to compensate the winners or accept any liability for loss, damage, personal injury or death occurring as a result of using and/or taking up (or failing to use and/or take up) the Prize except where it is caused by the negligence of the Promoter or its employees.
17. The Promoter will review the Cancer Research UK Giving Pages of all eligible participants in the Competition and the individual with the top Fundraising Total on the Closing Date will win the Competition.
18. If multiple eligible participants raise the same top Fundraising Total on the Closing Date each of those participants will be entered into a draw and the winner will be the first entry selected at random by a computer process. Reserve winners will also be selected in case the original winner cannot be contacted and/or does not provide the necessary information.
19. The winner will be notified within 5 days of the Closing Date via the details provided as part of the registration process for Game On. The Promoter will request a delivery address for the Prize from the winner and the prize will be delivered within 30 days of the Closing Date.
20. If a winner does not respond to communications within 5 days of notification, the Prize will be forfeited and the Promoter reserves the right to award the Prize to the participant with the next highest Fundraising Total or to the next reserve winner as described in paragraph 18 (if applicable). The Promoter’s decision will be final and no correspondence will be entered into.
21. The Promoter reserves the right to (i) cancel or suspend the Competition; (ii) cancel or refuse any entry and (iii) amend these Terms and Conditions (and will use reasonable endeavours to notify changes to participants).
23. The winner acknowledges that the Promoter may request their consent to participate in promotional activity and material relating to the Competition. However, for the avoidance of doubt neither entry into the Competition nor the likelihood of the entrant being the prize winner are conditional upon consent being given.
24. The winner’s surname and county (and the winning Fundraising Total) will be available for one month after the Draw Date to anyone who sends an email to the following address email@example.com. If the winner objects to this information being made available, they should inform the Promoter at the earliest opportunity. In such cases, the Promoter will not make their details available to members of the public but the winner acknowledges that the Promoter may still be required to share their details with a relevant regulator.
25. These Terms and Conditions shall be governed by and construed in accordance with English law and entrants agree to irrevocably submit to the exclusive jurisdiction of the English courts in respect of any dispute arising out of or in connection with them.

1. By signing up for Stand Up to Cancer Fundraising supporters you are agreeing to the CRUK fundraising terms and conditions which are available HERE.
2. When signing up you will be given the opportunity to not receive the additional support offered by the Stand Up to Cancer Team.
3. Should you wish to change your preferences after you have signed up for Stand Up to Cancer Fundraising you can do this by contacting us on 0300 123 3379 or emailing email@example.com or via this form.
5. OLAPIC GALLERY
I. STAND UP TO CANCER OLAPIC TERMS AND CONDITIONS
What is the Stand Up To Cancer Olapic gallery (the “Gallery”)?
The Gallery is a collection of images provided by supporters of Stand Up To Cancer’s fundraising events.
The Gallery can currently be found on The Great Stand Up To Cancer Bake Off page (http://www.standuptocancer.org.uk/bake-off), and images from the Gallery may also feature elsewhere on our website, across our social channels, email communications and marketing materials.
How do I upload photos to the Gallery?
To make your photos available for selection to the Gallery (“Photos”) you can upload them via Instagram or Twitter by using any of the hashtags #GBBO, #StandUpToCancer, #StandUpToCancerUK, #SU2C or #BakeOff (the “Hashtags”) alongside each Photo. We are able to find Photos by searching for the Hashtags, so please make sure your profile is public so we can find them.
If we would like to use your Photo, we will contact you for confirmation so that we may feature this Photo in the Gallery. We will do this by sending you a public message via Instagram or Twitter (as applicable). You will need to respond “#YesSU2C” to grant permission for us to use the photo.
You may also submit your Photo for selection to the Gallery using the ‘Upload a photo’ button feature on the Olapic Gallery on this page: http://www.standuptocancer.org.uk/bake-off. By uploading your photo via the Gallery you are agreeing to these terms and conditions and we will not need to contact you to grant permission to use the photo for the purposes set out below.
Please note that we are unable to contact anyone who submits a Photo that is not featured in the Gallery, or provide reasons why we have not used their Photo(s). However, we are very grateful for each user taking the time to make your Photo(s) available to us.
How will my Photo be used?
By responding “YesSU2C” to our Instagram or Twitter request, or by uploading your photo via the ‘Upload a photo’ button feature, you acknowledge and agree to the following:
1. You grant Cancer Research UK, and their approved third parties, an irrevocable, royalty free, perpetual, worldwide licence to use your Photo in the Gallery, on any page on the Stand Up To Cancer website (su2c.org), any of Stand Up To Cancer’s social media platforms (including but not limited to Instagram, Facebook and Twitter) and for any other commercial and/or fundraising purpose, which may include (but is not limited to) publications, advertising or other marketing materials (for example in emails or mailings);
2. We may alter and/or edit your Photo in any manner, or combine your Photo with other materials, without seeking further permission from you; and
3. That (i) you own the copyright and waive any moral rights in the Photo(s), or that you have obtained all necessary rights, consents and/or waivers from the owner to upload the Photo(s) to grant the rights set out in these Terms and Conditions; (ii) you are the person featured in the Photo(s) and/or you have permission from any person(s) appearing in your Photo(s) (and, if they are under 16, their parent or legal guardian as well) to grant the rights set out in these Terms and Conditions; (iii) you are 18 years or older; and (iv) our use of your Photo(s) in accordance with these Terms and Conditions will not violate any other rights of any third party or any law.
Any information you provide in relation to the Gallery will be collected and maintained in accordance with our privacy statement.
What happens if I have a complaint about a Photo or want my Photo removed?
All Photos selected to feature in the Gallery will be publicly accessible. Therefore, if you believe a Photo on the Gallery is inappropriate, offensive or is violating someone’s legal rights then you can report the Photo by sending an email to firstname.lastname@example.org. Once an email report is received, we may remove the Photo in question whilst we investigate further (which may include contacting the sender of the Photo for more information). We also reserve the right to remove Photos from Gallery at our discretion.
Please note that whilst we can remove Photos from the Gallery at any time, this will not necessarily erase its presence completely from the internet.
6. STAND UP TO CANCER QUIZ FOR AMAZON ALEXA
I. TERMS AND CONDITIONS
Welcome to our Amazon Alexa Skill Application (the “App“). This App is published by or on behalf of Cancer Research UK ("CR-UK ” “We” “Us“ or “Our”) a registered charity in England and Wales (1089464), Scotland (SC041666) and Isle of Man (1103) a company registered in England and Wales under company number 4325234, whose registered office at 2 Redman Place, London, E20 1JQ.
General rules relating to conduct
The App is made available for your own, personal use. The App must not be used for any commercial purpose whatsoever or for any illegal or unauthorised purpose. When you use the App you must comply with all applicable UK laws and with any applicable international laws, including the local laws in your country of residence (together referred to as “Applicable Laws”).
You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:
(a) Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or
(b) Attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; or
(c) Modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.
You agree to indemnify Us in full and on demand from and against any loss, damage, costs or expenses which We may suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.
The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations, data analytics and associated reporting and other material (“Material“) is owned by or licensed to Us. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without Our express permission.
The trademarks, service marks, and logos (“Trade Marks“) contained on or in the App are owned by Us. You cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without Our prior written consent.
Link to third parties
The App may contain links to websites operated by third parties (“Third Party Websites“). We do not have any influence or control over any such Third Party Websites and, unless otherwise stated, We are not responsible for and do not endorse any Third Party Websites or their availability or contents.
(b) How does CR-UK use analytics services provided by Amazon analytics: We together with our third party supplier, use data to measure user community behaviour to better develop our App. By using analytics services, We can analyse which skill actions are taken and how long for and which links are followed, so that we can provide more content which is of interest. The information generated by the use of our App will be transmitted to Amazon analytics and stored on servers owned or maintained by or on behalf of our service provider in the United States, United Kingdom and/or other countries outside the EEA. They may also transfer this information to third parties where required to do so by law, or where such third parties process the information on their behalf. By using this App, you consent to the processing of data about you by those service providers in the manner and for the purposes set out above.
USE OF THE APP IS AT YOUR OWN RISK. THE APP IS PROVIDED ON AN “AS IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE DISCLAIM ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE APP; AND (B) ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS RELATING TO THE APP (WHETHER IMPLIED BY STATUE, COMMON LAW OR OTHERWISE), INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON INFRINGEMENT, INFORMATION ACCURACY, INTEROPERABILITY, QUIET ENJOYMENT AND TITLE ARE, AS BETWEEN US AND YOU, HEREBY EXCLUDED. We will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the App, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.
IF WE ARE LIABLE TO YOU DIRECTLY OR INDIRECTLY IN RELATION TO THE APP, THAT LIABILITY (HOWSOEVER ARISING) SHALL BE LIMITED TO: (A) ONE POUND STERLING (£1.00); OR (B) THE SUMS PAID BY YOU UPON PURCHASING THE APP, OR ANY IN-APP SPEND, INCLUDING SUBSCRIPTIONS WHICHEVER IS THE LESSER.
Nothing in these Terms shall be construed as excluding or limiting Our liability for death or personal injury caused by its negligence or for any other liability which cannot be excluded by English law.
We reserve the right to suspend or cease providing any services relating to the App, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if We choose to do so.
Advertisers in the app
We accept no responsibility for adverts contained within the App. If you agree to purchase goods and/or services from any third party who advertises in the App, you do so at your own risk. The advertiser is responsible for such goods and/or services and not Us and if you have any queries or complaints in relation to them, your only recourse is against the advertiser.
If you take part in any competition which is run in or through the App (“Competition“), you agree to be bound by the rules of that competition and any other rules specified by Us and/or the promoter of the competition from time to time (“Competition Rules“) and by Our decisions, which are final in all matters relating to the Competition. We reserve the right to disqualify any entrant and/or winner in its absolute discretion without notice in accordance with the Competition Rules.
These Terms (as amended from time to time) constitute the entire agreement between you and Us concerning your use of the App.
We reserve the right to update these Terms from time to time. If, We do so, the updated version will be effective immediately, and the current Terms are available through a link in the App to this page. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the App. No other variation to these Terms shall be effective unless in writing and signed by an authorised representative on behalf of Us.
These Terms shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.
If any provision(s) of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties (as reflected in the provision(s)) and all other provisions shall remain in full force and effect.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Us in writing.
Unless otherwise expressly stated, nothing in the Terms shall create any rights or any other benefits whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise in favour of any person other than you and Us.
Sprintathons are organised by independent event organisers (see list below) in aid of Stand Up To Cancer. All event organisers are encouraged to ensure that safety and risk management are a top priority at all times. Cancer Research UK does not accept responsibility for any loss, damage or injury caused as a result of taking part in the event.
